Terms and Conditions

These terms apply to your use of witzkeandco.com (the “site”) and to the emails and text messages you sign up to receive from Witzke & Co. (“we,” “us,” “our”). By using the site or signing up, you agree to them. If you don’t agree, please don’t use the site.
Using the site
You may browse the site and share links to it for your own personal or business purposes. You agree not to:
Copy, scrape or republish our content in bulk, or use it to train AI models, without our written permission.
Interfere with the site’s security or operation, or try to access parts of it you’re not meant to.
Submit false information or someone else’s contact details through our forms.
Use the site for anything unlawful.
Our work and content
The site’s design, writing, images, case studies, our logo and brand mark belong to Witzke & Co. or to our clients and collaborators, and are protected by copyright and trademark law. Client work appears with permission and remains the property of its owners. Nothing on the site gives you a license to use it, other than viewing it and sharing links.
Inquiries, proposals and pricing
Information on the site, including service descriptions, prices and timelines, is general and may change. It is not an offer. Any project we take on is governed by a separate written proposal or agreement signed by both parties, and that agreement controls if it conflicts with these terms. Submitting a form or booking a call doesn’t create a client relationship.
Email newsletter
If you subscribe, we’ll send occasional emails about our work, ideas and offers. You can unsubscribe at any time using the link in any email or by writing to hello@witzkeandco.com.
Text messages (SMS)
Program. Witzke & Co. sends text messages to people who opt in through our website forms, booking pages or in conversation with us. Messages may include replies to your inquiry, appointment reminders, project updates and, if you opt in to them, occasional marketing messages.
Consent. By giving us your mobile number and checking the consent box, you agree to receive recurring texts from Witzke & Co. at that number, including texts sent with automated technology. Consent is not a condition of any purchase.
Frequency and costs. Message frequency varies. Message and data rates may apply, according to your mobile plan.
Opting out and help. Reply STOP to any message to stop receiving texts. We’ll send one confirmation and then no further messages unless you opt in again. Reply HELP for help, or contact hello@witzkeandco.com or +1 279-205-6366.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Privacy. We handle your mobile number as described in our Privacy Policy. We don’t share mobile numbers or text messaging consent with third parties for their marketing.
Links to other sites
The site links to third-party sites and platforms, such as Instagram, LinkedIn, YouTube, TikTok and our scheduling and form tools. We aren’t responsible for their content or practices, and their own terms apply.
No warranties
We work hard to keep the site accurate and available, but it is provided “as is” and “as available.” To the extent the law allows, we make no warranties of any kind about the site or its content, and we don’t promise it will be error-free or uninterrupted.
Limitation of liability
To the extent the law allows, Witzke & Co. won’t be liable for any indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of the site or our emails and texts. Our total liability for any claim related to the site will not exceed $100. Nothing in these terms limits liability that can’t be limited under law.
Indemnity
If you misuse the site or break these terms, you agree to cover any reasonable costs, including legal fees, that we incur as a result.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Sacramento County, California, and you and we consent to their jurisdiction.
Changes to these terms
We may update these terms from time to time. When we do, we’ll change the effective date above. Continuing to use the site after an update means you accept the new terms.
